|Administrative Branch (AB)
The AB shall have the following Divisions and its functions:
|Human Resource Division (HRD):
The HRD’s functions encompass on the formulation and implementation of human resource management (recruitment, selection and placement of personnel; appointments; employee benefits; discipline; leave and attendance; separation; promotion; employee suggestions and incentive awards system) and human resource development programs (staff development and training.
General Services Division (GSD):
The GSD shall provide collection, distribution, and custodial work, among others, with the following functions:
Provide policy guidance on the maintenance and disposition of records and on the procurement and storage of supplies in accordance with government prescribed standards;
File and maintain necessary records and establish a records disposition program;
Provide mail, transportation, custodial, and general utility services;
Procure, store, and distribute the supplies and equipment and conduct periodic inventory of the same;
Provide and coordinate messengerial, duplicating and typing pool services; and,
Receive, collect, and deposit cash and process vouchers for payments of obligations.
|Planning, Finance and Management Branch (PFMB)
The PFMB shall have the following three (3) Divisions and one (1) Unit:
Corporate Planning and Programming Division (CPPD):
Organize the strategic planning exercise as basis for the Medium-Term and Annual Agency Plans;
Update the Information Systems Strategic Plan;
Coordinate, monitor and evaluate compliance with objectives and plans;
Prepare the NTC Annual Report and comprehensive accomplishment reports
Prepare programs for funds allocated for projects and capital outlay expenditures, in coordination with the Finance Division;
Prepare project proposals with corresponding profile and budgetary estimates for funding allocation, in coordination with the units concerned and the Finance Division;
Monitor the physical status of projects and prepare comprehensive assessment reports; and,
Act as custodian and maintain a central repository of all informative materials/documents in soft and hard copies, including but not limited to, country reports, reference and presentation materials, speeches, research and position papers and other related items collected from all NTC officials and employees who attend conferences, seminars, trainings, for both local and foreign.
Finance Division (FD):
Responsible for the preparation and execution of financial work plans, including control and reporting; and,
Maintain accounting records and books of accounts and process requisitions and vouchers for collections and disbursements and other budget and accounting functions in the NTC.
Management Division (MD):
Develop plans and programs relative to management improvements in the Agency;
Examine the administrative organization of the Agency and provide recommendations for improvement;
Maintain and update the Agency organization chart and other manuals;
Conduct regular management surveys of the organizational structure, manpower and operations, studies and procedures/processes, and provide recommendations for improvement;
Develop new and improved management systems, and provide staff supervision over the implementation of such improvements, as well as conduct training on the application of survey/s; and,
Develop the staffing standards and manpower requirements of the agency.
Information Technology Unit (ITU):
Coordinate the planning, evaluating and implementing of NTC ICT strategies
Develop Strategic Planning on ICT utilization as part of management improvement tool;
Provide consultation and advice on the issues of ICT usage to NTC’s top management and other interested parties.
Formulate uniform policies, processes and implementation procedures for ICT based projects and office automation.
Provide basic communication and network infrastructure suitable for ICT and systems based projects and to determine that computing and telecommunications equipment operate perfectly and in the state service readiness.
Simplify and coordinate the implementation and integration of application systems inclusive of Electronic Government (EG) applications.
Create and manage updated data base, accurate and easily available thus becoming an information resource centre to the Government and the private sector.
Determine the quality, security and validity of NTC’s guaranteed information system data and ensuring that all safety aspects have been taken into account during the planning and implementing of ICT development projects.
Audit and reassess present ICT based projects to determine its economic benefits, quality assurance and functions suitability.
Raise the level of awareness and ICT usage skills among officers.
|Industry Planning and Management Branch (IPMB)
The IPMB shall undertake sectoral planning and ensure the quality, safety, reliability, security, compatibility and interoperability of telecommunications facilities and services in conformity with standards and specifications set by international radio and telecommunications organizations to which the Philippines is a signatory. The IPMB shall have one (1) division:
Industry Planning and Research Division (IPRD):
The IPRD shall be responsible for the provision of services relating to broadcast and public telecommunications industry planning and development, and advice to management on the status, current trends and developments in the broadcast and telecommunications industry; and continuing analysis of economic conditions and trends relating to the sectoral area in which the NTC is concerned.
|Special Licensing Branch (SLB)
The SLB shall act on all non-decentralized radio service licenses pursuant to local and international radio rules and regulations, conventions, and treaties where the Philippines is a party.The SLB would have the following two (2) Divisions:
Special Radio Services Division (SRSD):
This division would act on all non-decentralized licensing functions of non-carrier radio communications network in the fixed and land mobile services, and all applications for permit to import radio communications equipment, wireless data network equipment and devices filed through the Philippine National Single Window.
Safety Radio Services and STCW Compliance Division (SRSSCD):
This Division would be tasked to:
Act on all non-decentralized licensing applications for maritime, aeronautical, and safety services pursuant to local laws and international radio regulations, conventions and treaties where the Philippines is a party and which are not enumerated in the Memorandum Circulars/Orders defining certain decentralized licensing functions of the Commission; and,
Undertake the functions of the Radio Operators and Training Schools Division on the implementation of the Standards of Training, Certification and Watchkeeping (STCW) Code of the International Maritime Organization (IMO) and issue licenses, permits and certificates to radio training centers and radio operators.
|Legal Branch (LB)
The LB shall have three (3) division-level units in order to strengthen the quasi-judicial functions of NTC. The Divisions with its functions are:
Internal Legal Affairs Division (ILAD):
This Division shall have the following functions:
Conduct investigation of personnel;
Review administrative charges against erring employees of the Commission;
Administer oaths on matters generally involving the Commission and the units and ROs under it, among others.
Adjudication Division (AD):
Conduct formal hearings on applications for Certificates of Public Convenience and Necessity for the operation of communications utilities and services, radio communications systems, wire or wireless telephone or telegraph systems, radio and television broadcasting systems, and other similar public utilities and petitions for authority to charge rates, increase capitalization, incur loans and other related matters;
Investigate complaints and/or prosecute infractions of the Public Service Act, as amended, telecommunications laws and regulations, and such other applicable laws, including violations of the terms and conditions of certificates and licenses or permits issued by the Commission;
Prepare draft decisions of cases involving violations of the Public Service Act, as amended, telecommunications laws and regulations, and such other applicable laws, including violations of the terms and conditions of certificates and licenses or permits issued by the Commission; and
Represent the Commission in tribunals or other government entities where it is a party-in-interest and in court litigations, in coordination with the Office of the Solicitor General.
Consumer Welfare and Protection Division (CWPD):
Develop and implement plans, programs and procedures on matters related to the promotion and enhancement of consumer welfare and protection pursuant to RA No. 7925 and other existing laws, rules and regulations;
Continually conduct researches and studies on ways and means to further improve and enhance consumer affairs;
Act on all consumer complaints related to the provision of services by public telecommunications entities (PTEs), broadcast and CATV companies, radio and telecommunications equipment suppliers, including radio dealers and mobile phone suppliers;
Handle complaints regarding stolen mobile phones and illegal/obscene texts and messages, including spam, fraudulent texts, threats and other related items, in coordination with appropriate offices and agencies;
Collate and monitor all received complaints and promptly forward the same to service providers concerned and the various units of the Commission;
Coordinate with other appropriate government agencies regarding the timely and effective resolution of complaints; and,
Attend meetings, seminars and/or workshops on matters related to the promotion of consumer welfare and protection.
|Regulation Branch (RB)
The RB shall supervise and regulate all public telecommunications entities by formulating and developing rules and regulations. The RB shall have two (2) Divisions:
Networks and Facilities Division (NFD):
This division shall conduct studies and recommend policies, rules and regulations on the installation and operation of public telecommunications networks and facilities;
Recommend minimum technical and network standards;
Prepare evaluations and analyses on all applications for permits and licenses filed by public telecommunications entities as part of the authorization and registration process; and,
Recommend rules and regulations on the payment of fees and charges for the installation and operation of the networks and facilities of telecommunications entities.
Services and Interconnection Division (SID):
The SID shall conduct studies and recommend policies, rules and regulations on the provision of public telecommunications services and on all aspects of interconnection; prepare evaluate, analyse and recommend action on all applications for authorization and registration by public telecommunication entities; recommend minimum service performance standards; and prepare studies, comments, position papers and recommendations on international issues affecting the Philippine telecommunications sector, including international traffic settlements, matters and issues raised by international organizations.
|Other Offices Under the Office of the Commissioner|
Radio Spectrum Planning Division (RSPD):
Assign frequencies of broadcast stations and auxiliary broadcast facilities based on the sub-allocated band plans of the Commission;
Provide long term policies in planning, coordinating, regulating and administering the use of radio spectrum within the country, except for radio services with pre-allocated frequency bands, such as the maritime, aeronautical and radio broadcast services (AM and FM radio and television);
Undertake continuing studies of frequency allocations to various services in accordance with the ITU Table of Frequency Allocations to meet local requirements, as well as of new technical developments affecting frequency usage to promote a nationwide and more effective utilization of the radio frequency spectrum;
Sub-allocate radio frequency bands for various radio services in accordance with international regulations, national priorities and factors that may influence spectrum planning, namely: policy and legal, economics, social, ecological and technical factors;
Establish and maintain the National Radio Frequency allocation Table (NRFAT) and review the same, as necessary, and prescribe regulations, technical parameters and standards governing the use of frequency bands or specific frequency by station of different services having regard to current national and international standards;
Maintain an accurate and up-to-date Master Frequency Register (MFR) of all assigned frequencies and authorized radio stations for effective spectrum planning and policy formulation, licensing and enforcement activities, interference investigation and resolution, national and international coordination and for financial considerations;
Conduct electromagnetic compatibility analyses required and determine appropriate frequency assignments for radio networks in conformity with the NRFAT and the MFR; and,
Recommend solutions to harmful radio frequency interference (RFI) and make appropriate action.
Broadcast Services Division (BSD):
Assign frequencies of broadcast stations and auxiliary broadcast facilities based on the sub-allocated band plans of the Commission;
Prepare and maintain records of frequency assignments made and call-signs issued, furnishing the RSPD;
Act of applications for the issuance of permits and licenses for broadcast TV and radio (AM/FM) stations;
Conduct economic, technical and financial evaluation of new applications for AM, FM, TV and CATV stations/systems and prepare appropriate recommendation/s;
Prepare an assessment of supervisory and regulatory fees (SRFs), permits and license fees;
Formulate and prepare policy guidelines on regulatory and quality standards systems compliance on radio regulatory and licensing compliance pertaining to various radio stations, networks and services, telecommunications dealers, manufacturers, repair centers and radio personnel; and
Update/maintain a database on issued permits and licenses.
Commission Secretariat (ComSec):
Record and report the proceedings of the Commission;
Docket all cases filed with Commission and schedule them for hearing;
Assist the Commission on matters affecting petitions and applications for authorizations, i.e., Certificates of Public Convenience and Necessity (telecommunications), Certificates of Public Convenience (broadcast), Certificates of Authority (CATV), and other related matters;
Prepare and serve summons;
Compile orders, rulings and decisions for publication which, in the judgment of the Commission, may be of general public interest;
Issue certified copies of decisions, orders and other related papers to interested parties; and,
Act as clerk of the Commission
Equipment Standard Division (ESD):
Undertake research, formulate and develop technical regulations and standards for telecommunications and broadcast equipment, in coordination with the other units, other government agencies, equipment vendors, telecommunications companies, professional and consumer organizations, foreign regulators and regional/international standards organizations;
Promulgate technical regulations and standards in accordance with local standards or regulations and align them with international standards as the basis for conformity assessment (testing and certification) of telecommunications and broadcast equipment for the Philippine market after public hearings/consultations with stakeholders;
Identify, designate and monitor Conformity Assessment Bodies within Philippines;
Coordinate with other Designating Authorities that are member-parties to the APEC and ASEAN MRAs relative to the effective functioning of such MRAs;
Coordinate with the NTC ROs for the conduct of post market surveillance activities to determine whether or not the telecommunications and broadcast equipment/products placed in the Philippine market comply or conform with the NTC technical regulations and standards;
Conduct laboratory testing of telecommunications and broadcast equipment from non-MRA partners, subject to the availability of test instruments and technical personnel;
Issue Type approval certificates for telecommunications and broadcast equipment; and
Formulate rules and regulations concerning telecommunications and broadcast equipment dealers, suppliers, resellers, distributors, manufacturers and service centers.
Regional Offices (ROs):
The NTC ROs are under the direct supervision and control of the Office of the Commissioner. Field units directly implement the plans and programs of an agency within their respective jurisdictions, and are directly responsible to the Agency Head.
The ROs perform the following:
Enforce and implement telecommunications laws and other pertinent laws, decrees, letters of instructions, and rules and regulations promulgated therewith, as well as policies and guidelines set by the Commission governing the installation and operation of all telecommunications services or stations and facilities, including radio and television broadcasting systems within the regional area;
Upon authority of the Commission, conduct hearings for the grant of authorization to operate telecommunications public utilities or services and submit recommendation thereon to the Commission;
Issue licenses and permits that may be specified;
Attend to the inspection and field investigation of all telecommunications services or stations, including radio and television broadcasting system, and in the monitoring of the radio frequency spectrum;
Issue and/or approve, through delegated authority, appointments of personnel below the rank of Division Chief, as well as requisitions and procurement of supplies, materials and equipment for the RO;
Assist the Legal Branch in the conduct of administrative investigation against erring employees below the rank of the Assistant Regional Director of the RO;
Conduct studies on telecommunications service requirement of the region and submit recommendation to the Commission;
Collect, consolidate and update statistical data and other related information on telecommunications services or stations, including operational statistics, for periodic presentation and submission to the Commission;
Maintain liaison and coordination work with the ROs or units of other agencies within the region, including the offices or units of local government;
Administer oaths on matters generally involving the official business of the RO;
Represent the Commission in conferences or meetings, whenever necessary, that may be held in the region; and,
Coordinate enforcement activities with the military and the police for the effective implementation of telecommunications laws and regulations regarding stations or services whose operation affect the security of the State.
Except for those not decentralized as discussed earlier, the same functions would be undertaken by the ROs.
